Clear Nation Entertainment Prize Fulfillment Agreement

This Prize Fulfillment Agreement (“Agreement”) is entered into between Clear Nation Entertainment (“CNE”) and the verified winner (“Winner”).

1. Purpose

This Agreement outlines the terms governing the transfer and acceptance of a prize awarded through a CNE giveaway promotion.

2. Winner Verification

Prior to receiving any prize, Winner must provide:

  • Government-issued photo identification
  • Completed Affidavit of Eligibility
  • Signed Liability Release
  • Signed Publicity Release (where permitted by law)
  • Any tax documentation required by law

Failure to complete verification may result in forfeiture of the prize.

3. Prize Acceptance

Winner acknowledges acceptance of the prize as awarded.
Prizes may include:

  • Vehicles
  • Residential homes
  • Cash alternatives
  • Other promotional prizes

Prizes are non-transferable except as expressly approved by CNE.

4. Cash Alternative

Where offered, Winner may elect to receive a cash alternative.
The cash amount shall be determined solely by CNE based upon the stated prize value and applicable administrative costs.

5. Vehicle Prize Fulfillment

If the prize includes a vehicle:
CNE agrees to:

  • Deliver title documents
  • Pay Title, Tax, and License fees (if advertised)
  • Coordinate vehicle delivery

Winner agrees to:

  • Maintain insurance coverage
  • Possess a valid driver’s license
  • Execute transfer documents

Ownership transfers upon completion of title transfer.

6. Home Prize Fulfillment

If the prize includes a home:
CNE agrees to:

  • Facilitate deed transfer
  • Coordinate closing documents
  • Deliver applicable warranties

Winner agrees to:

  • Execute closing documents
  • Obtain homeowners insurance
  • Assume all future ownership costs

Ownership transfers upon recording of the deed.

7. Taxes

Winner acknowledges that prizes may constitute taxable income.
Winner is solely responsible for:

  • Federal taxes
  • State taxes
  • Local taxes

CNE may issue IRS Form 1099 as required.

8. Release

Winner releases CNE from all liability arising after prize transfer.

9. Governing Law

This Agreement shall be governed by Texas law.
Venue shall be Harris County, Texas.
